Milk & Moon — Terms of Service

1. Acceptance of These Terms
Milk & Moon ("the App") is operated by Milk and Moon LLC ("we", "us", "our"). By downloading, creating an account in, or using the App, you agree to these Terms of Service. If you do not agree, please do not use the App.
Our Privacy Policy explains what we collect and why, and forms part of these Terms.
2. Medical Disclaimer
The information in the App is provided for educational purposes only and is not a substitute for individualized medical care. Breastfeeding situations vary widely. Consult your pediatrician, obstetric provider, or an International Board Certified Lactation Consultant (IBCLC) for personal guidance on feeding concerns or medical questions.
The App does not diagnose, treat, or monitor any medical condition. Its charts, tips and reminders are informational. Never delay seeking medical advice because of something you read here.
In an emergency, call your local emergency number. In the United States that is 911, or 988 for the Suicide & Crisis Lifeline. The App is not an emergency service and cannot summon help.
3. Who May Use the App
You must be at least 18 years old and able to form a binding contract. The App is designed for parents and caregivers tracking the care of an infant in their charge. You are responsible for having the authority to record information about any child whose care you log.
4. Your Account
You are responsible for keeping your sign-in credentials confidential and for activity that occurs under your account. Tell us promptly at milkandmoonapp@gmail.com if you believe your account has been accessed without your permission.
You agree that the information you give us when creating an account is accurate, and that you will keep it current.
5. Subscriptions & Billing
Milk & Moon is offered on a subscription basis, billed monthly or annually. A 14-day free trial is available to new subscribers. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Payment is charged to your Apple App Store or Google Play account. You can manage or cancel a subscription at any time in that account's settings. Cancelling stops the next renewal; it does not refund the period already paid for. Refunds are handled by Apple or Google under their policies, not by us.
If a free trial is not cancelled before it ends, it converts to a paid subscription at the rate shown when you signed up.
Founding 500 pricing. Our first 500 subscribers pay an introductory rate. Once those places are taken, the price of a new subscription will rise. If you subscribe at the introductory rate, that rate will not increase for as long as your subscription remains continuously active.
Two limits apply to that commitment, both set by the app stores rather than by us. If your subscription lapses — because you cancel, or because a payment fails past its grace period — resubscribing later creates a new subscription at the price then current. And if you switch between the monthly and annual plans, the plan you move to is charged at its current price.
Prices are shown in your local currency and vary by region. Where a future price appears alongside the introductory price, it is our current intended standard price and may itself change.
6. Care Orbit
Care Orbit lets you invite partners, family members or other caregivers to log entries for your baby. When you send an invitation you are choosing to share your baby's feeding, diaper and weight records with that person, and you are confirming you have the authority to do so.
You can remove someone from your care team at any time in the App, which ends their access immediately. People you invite can log entries but cannot invite others, view growth charts, or manage your account or subscription.
Care team access depends on your subscription. If your subscription ends, their access ends with it.
7. Acceptable Use
You agree not to:
Use the App for anything unlawful, or to record information about a child you have no authority to record.
Attempt to access another user's account or data.
Probe, scan, reverse-engineer, decompile, or interfere with the App or the servers behind it, except where that right cannot lawfully be restricted.
Use automated means to extract data from the App, or resell or redistribute its content.
Circumvent, disable or interfere with subscription or access controls.
We may suspend or terminate an account that breaches this section.
8. Deleting Your Account
You can delete your account at any time from Settings → Account → Delete Account. No email to us is required and no waiting period applies.
Deleting your account signs you out on every device, erases the copy of your data held on the device you are using, and removes your account from our servers as described in the Privacy Policy. If people accepted your care team invitations, their access ends at the same moment. If you accepted someone else's invitation, your access to their baby's records ends and you are removed from their care team — their own records are unaffected.
Your subscription is held by the App Store or Google Play, not by us, and deleting your account does not cancel it. Cancel the subscription in your store account first, or billing will continue.
9. Our Content
The App, its education library, its illustrations and its software are owned by us or our licensors and are protected by copyright and other laws. Your subscription grants you a personal, non-transferable licence to use the App and read its content for your own family's use. It does not let you copy, publish, distribute or create derivative works from that content.
The records you enter — your feeding logs, weights, notes and baby profiles — remain yours.
10. Availability
We work to keep the App running and its data synced, but we do not guarantee uninterrupted or error-free service. Features may change, and we may add, modify or withdraw features over time. Sync depends on your network and on services we do not control.
Keep your own copy of anything you cannot afford to lose. The App can export your records, and we recommend doing so periodically.
11. Disclaimers
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App's information, charts or percentile comparisons are accurate for your child, or that they are suitable for making medical decisions. Growth charts are drawn from published World Health Organization reference data and describe populations, not individuals.
12. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the App.
Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
13. Changes to These Terms
We may update these Terms from time to time. Significant changes will be announced with an in-app notice before they take effect. Continuing to use the App after a change takes effect means you accept the updated Terms. If you do not accept them, delete your account.
14. Governing Law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in the State of Alabama, and you and we consent to that jurisdiction. If you are a consumer resident elsewhere, you keep any rights to bring proceedings in your own country that local law grants you.
